New York CNN —Move over vapes, Americans appear to have a new addiction: Zyn, a tobacco-free nicotine pouch product, that has exploded in sales over the past year. Philip Morris announced Thursday that it shipped about 350 million cans of Zyn in 2023, a whopping 62% growth compared to the previous year. Nicotine is very addictive and can harm young people’s developing brains, according to the US Centers for Disease Control and Prevention. However, like Juul, the popularity and growth of Zyn might face difficulties, in particular from US government. “Zyn is the next battle.”Despite the growth, shares of Phillip Morris declined 2% in early trading because of lower demand for cigarettes.

PARIS (AP) — The French parliament is considering a ban on single-use, disposable electronic cigarettes that are popular with teenagers for their sweet flavors and are under scrutiny as a new source of trash. Disposable e-cigarettes are small, battery-powered devices that deliver vaporized nicotine with various flavorings. While they do not contain tobacco, many include nicotine, a dangerous chemical known for its addictive properties. The surge in disposable e-cigarettes in the U.S. market, primarily from China, following the Food and Drug Administration’s 2020 ban on flavored reusable e-cigarettes like Juul, exemplifies the broader challenge. The flavor restrictions didn’t apply to disposable products, which proliferated in the wake of the regulation.

The company did not immediately respond to a request for comment on how it plans to use these funds. NEW YORK (AP) — Fewer high school students are vaping this year, the government reported Thursday. In a survey, 10% of high school students said they had used electronic cigarettes in the previous month, down from 14% last year. Use of any tobacco product— including cigarettes and cigars — also fell among high schoolers, according to the Centers for Disease Control and Prevention report. — About 1 in 10 middle and high school students said they recently had used a tobacco product. There was a slight increase in middle schools students who said they had used at least one tobacco product in the past month, while that rate fell among high school students.

About 90 percent of the students who reported vaping said they used flavored products, citing favorites that tasted like fruit and candy. Public health experts also linked other state and local flavor bans and education campaigns to the falling high school vaping rate, which is the lowest in nearly a decade. In all, about 2.1 million middle and high school students reported using e-cigarettes, down from 2.5 million last year. While the agency has authorized about two dozen vaping products for sale, thousands of illicit candy-colored flavored vapes have flooded the country and are top sellers. Other researchers noted that the combined general use of tobacco products by middle and high school students barely fell, to 10 percent this year from 11 percent last year.

Altria Group, the parent company of Philip Morris USA and the nation's largest tobacco company, reported third-quarter results Thursday that fell short of Wall Street's expectations as demand for its core cigarette business cools and illicit e-vapor products flood the market. The Marlboro maker said its domestic cigarette shipment volume decreased 11.6%, primarily driven by wider declines across the industry and competition from illicit e-vapor products, among other factors. In a conference call with analysts, Altria CEO Billy Gifford said the lack of regulation of illicit e-vapor products has come at the expense of legal operators and approved. Although federal crackdowns have placed more restrictions on the flavors and marketing for tobacco products, illicit operators are skirting many tobacco-related laws and are flooding the market with disposable e-cigarettes that aren't FDA-approved and are illegal to sell. Like many other tobacco companies, Altria is moving beyond traditional, combustible cigarettes and towards smoke-free products.

The move escalates a dispute between the two e-cigarette makers after Juul filed a similar patent infringement case against NJOY at the ITC in June. NJOY said in its filings that Juul products infringe two of its patents, and that it intends to obtain a ban on products including its currently marketed Juul device and Juul pods. NJOY also sued Juul in Delaware on Tuesday for infringing the same patents, seeking an unspecified amount of damages. Juul filed its own patent lawsuits against NJOY and Altria at the ITC and in Arizona federal court in June, seeking money damages and a ban on imports of NJOY's Ace vapor device. Altria won more than $95 million from cigarette rival R.J. Reynolds in North Carolina federal court last year after a jury found RJR infringed other Altria e-cigarette patents.

Marlboro maker Altria Group said Tuesday its subsidiary NJOY has sued Juul Labs — the e-cigarette company it once held significant stake in — over patent infringement of certain e-vapor products. Altria has called for a ban on the importation and sale of these Juul products. Altria bought full global ownership of NJOY's e-vapor product portfolio in June for approximately $2.75 billion. The deal included the product NJOY ACE, the only pod-based vape with market authorizations from the U.S. Food and Drug Administration. In addition to the lawsuit filed with the ITC, Altria filed a similar suit against Juul in the U.S. District Court for the District of Delaware.

Young people are at risk of experiencing significant respiratory symptoms, including bronchitis and shortness of breath, after just 30 days of electronic cigarette use, according to a new study released Tuesday. They said the study, partly funded by the National Institutes of Health, contributes to existing evidence that e-cigarette use is associated with an increased risk of respiratory symptoms. Drug regulators should consider the findings and work to minimize the negative health impact of e-cigarette use on young people, the researchers added. E-cigarette usage is now substantially higher among youths and young adults than it is among adults overall in the U.S., according to the Centers for Disease Control and Prevention. She noted that the study examines only teens and young adults, and that in the demographic of all adults, people "often switch from using cigarettes to using e-cigarettes with likely fewer risks."

Juul is working with Jefferies Financial Group Inc (JEF.N) for the fundraising, the report said, adding that the e-cigarette manufacturer had about $800 million in revenue in 2022. CNN —E-cigarette company Juul Labs is seeking US authorization to sell a “next-generation” vape with age verification capabilities in the United States. If authorized by the US Food and Drug Administration, Juul Labs hasn’t yet decided on the name to market their new product in the US. In total, Juul Labs has agreed to pay more than $1 billion in its various legal settlements. Even with limited flavors, the FDA banned Juul products in the US last year after reviewing Juul’s applications seeking marketing authorization for their devices.

A new CDC study found that some people have taken to smoking both cigarettes and vapes. Vapes were previously pitched as a way to switch or quit smoking cigarettes. Vapes have previously been marketed as a way to quit smoking cigarettes. Among all American adults, the CDC study found that 10.2% smoked only cigarettes, 3.2% smoked only e-cigarettes, and 1.3% smoked both. Meanwhile, adults aged 45 and over largely preferred cigarettes only, reporting the lowest percentages of e-cigarette use or dual use.
